It ensures the landlord's right to rent and the tenant's right to reside in the property. These legally binding agreements clearly define and protect the statutory rights of both parties.

In social housing, knowing your rights and responsibilities is key. Your social housing provides a lease agreement outlining your duties as a landlord. Choose between shorthold for flexibility or fixed-term for commitment. Pick what suits you best and invest confidently!

New Tenant Arrangements 

Newcomers and for individuals to housing association properties may be offered a starter lease, typically lasting 12 months. This serves as a trial period to ensure both parties for fill their rights and obligations. After this initial period, investors can transition to a fixed-term lease, which can last 2, 3, 5, or even 10 years in some cases.

Fixed Term Lease 

In a fixed-term lease, the social housing provider is responsible for rent and related obligations. Changing the terms of this agreement is difficult once established. It's advisable to carefully review the contract to ensure clarity on the rights and responsibilities of both parties before committing to this type of lease.

In the UK, social housing rental entails certain limitations, with landlords receiving a lease agreement from the local housing provider, albeit with differing terms.

While this arrangement prevents investors from leasing their property on the open market while a tenant occupies it, it ensures that the housing provider will consistently and promptly pay your rent.

Can Social Housing Tenants Be Evicted?

Yes, social housing tenants can be evicted, but strict rules regulate the process. Evictions usually result from serious breaches of the lease agreement or instances of anti-social behaviour.

Who Sets Rent in Social Housing?

Rent in social housing is typically determined by the social housing provider and local authorities.

If the investor decides to sell

If the investor plans to sell the property, a 90-day notice period is necessary for the social housing provider to find alternative accommodation. If the investor sells the property to another investor while keeping the social housing provider, a new lease agreement will be signed with the new investor to ensure continuity of the existing contract.

Repairs & Maintenance

In the event of  i.e a boiler replacement, structural issues, roof leaks,  the landlord is responsible for the costs and must address the matter promptly. As per the contract, the provider is obligated to return the property to the landlord in its original condition. Reports, surveys, and imagery evidence will be available during handover and return to the investor, all documented for reference. For more details, please refer to the lease agreement.
